Brown v. Caruso Homes, Inc.- On March 9, 2023, The Law Offices of Gilda A. Hernandez, PLLC obtained a jury verdict on behalf of its client, Ms. Brown, in the North Carolina, Superior Court Division (Wake County), awarding her actual and double damages, along with prejudgment interest pursuant to the North Carolina Wage and Hour Act (“NCWHA”) due to Defendant, Caruso Homes Inc’s, failure to pay promised commissions. Between the jury and the Court’s ruling(s), our client was awarded approximately $276,000.00.” The Parties are still litigating Ms. Brown’s attorneys’ fees and costs.

Webb v. Freedom House and Daymark- On May 10, 2023, after a two-day trial in the United States District Court for the Middle District of North Carolina (MDNC), a resolution was reached between our client, Mr. Webb, and his former employers, companies in the mental healthcare industry. Following one day of jury selection and one day of witness examinations, the parties were able to reach a mutually beneficial resolution. The original claims brought against our client’s former employers were for unpaid wages pursuant to the Fair Labor Standards Act (“FLSA”) and the North Carolina Wage and Hour Act (“NCWHA”), retaliation and wrongful termination pursuant to Section 15(a)(3) of the FLSA, along with claims of interference, retaliation, and wrongful termination in violation of the Family Medical Leave Act (“FMLA”). The settlement totaled $300,000.00.

Gobena v. Courier Net- In late February 2024, a fair and equitable arbitration ruling was reached for our client. Our client had brought forth original claims against Courier Net, for the company’s misclassification of her as an independent contractor and as exempt from overtime pursuant to the Fair Labor Standards Act (“FLSA”), failure to pay promised wages pursuant to the North Carolina Wage and Hour Act (“NCWHA”), and for claims of discrimination on the basis of her age, (“ADEA”). The arbitration award totaled approximately $300,000.00. We are proud of her successful award and ensuring that justice was served.
